In some politics related tribes there are often discussions about the "rule of law." Here is my 2 cents on this matter.
I wish for us to take a step away from the trees to possibly be able to see the forest.
I have long maintained that the "rule of law" is really the "rule of control", institutionalized in the time of old Greece with the establishment of the City States. This rule of law is a farce designed to maintain the current order of Patriarchal control which utilizes the "power over" dynamic as its primary tool. Over the millenia the "rule of law" has been repeatedly tweaked so that those who unjustly stole our cooperative way of living (controlling Patriarchs) could maintain their unjust system while providing a sense of fairness for those subject to the rules.
We are told the laws are to keep order. Who's order? We are led to believe that this is always the way it was, with a "power over" dynamic and tension and competition as the natural order. This is not how it always was and is not how it always will be..
This "power over" dynamic maintained through the "rule of law" replaced the "power with" cooperative model that predates our one sided handed down HIStory.
This is what we have learned from the remnants of the Minoan people of Crete who predate our modern history and lived in a wealthy, opulent, and sanitary "culture centered" civilization prior to being buried in HIStory, literally. These people had no weapons, fortifications, defenses, or any other power wielding systems or devises. They did not need them as they lived in cooperation with each other and nature. These people had no lower, middle, and upper classes or gender discrimination, as they were equals This civilization was buried in a firestorm and under ash after the volcano Thera blew its top and set the stage for the next era of humankind, the "power over" era of domination, violence, and control.
The "power over" dynamic has a low ceiling for potential compared to the "power with" model, or so game theory illustrates so well. We are possibly in the last throes of the "power over" era and may see its alloted time draw to a close in our lifetimes, as control begets control and eventually collapses under the illusionary constructs that prop it up. It is a house of marked cards awaiting its' full exposure as a thief and its' eventual certain demise.
Fairness under the rule of law is an illusionary concept as the Rule of law itself has as its primary directives the continued domination of the many by the few and the perpetuity of itself. How can there be fairness in an unfair unjust system? To find high value in the rule of law is to cast a silent vote for the current unnatural order of things today.

Re: Rule of Law?
Thu, September 27, 2007 - 5:02 PMIf morality in your society is legislated (laws) and enforced by armed thugs (police), then there is NO morality in your society.
